Molldi – Terms of Sale & Production

These Terms of Sale & Production (“Terms”) govern the purchase of custom-made products through the Molldi platform (“Molldi”, “we”, “us”). By placing an order, you (“Customer”, “you”) confirm that you have read, understood, and agreed to these Terms.

1. Scope of Agreement

These Terms apply to all orders placed through the Molldi platform for products that are designed, configured, and manufactured on a made-to-order basis using parametric design and advanced manufacturing technologies.

Molldi acts as the platform operator responsible for design validation, pricing, order routing, and coordination with manufacturing partners.

2. Custom-Made Products

All Molldi products are custom-made and manufactured specifically based on the parameters selected by the Customer at the time of order.

As such:

  • Products are not mass-produced
  • Each item is unique
  • Variations between products are inherent to the process

By placing an order, the Customer acknowledges that the product is made exclusively for them and cannot be resold or reused for another order.

3. Design Variability & Manufacturing Tolerances

Molldi products are manufactured using industrial processes such as large-format additive manufacturing (LFAM), CNC machining, or hybrid fabrication methods.

As a result:

  • Minor variations in color, texture, surface finish, layer patterning, and geometry may occur
  • Surface lines, seams, or material transitions may be visible
  • Digital previews, renders, or configurator visuals are illustrative only

These variations are not defects but inherent characteristics of advanced manufacturing and custom production.

4. Materials & Intended Use

Materials offered in the configurator are selected based on the intended use (e.g., indoor or outdoor).

The Customer is responsible for:

  • Selecting the appropriate material and usage category
  • Ensuring the product is used in accordance with its intended environment

Molldi is not responsible for damage caused by improper use, exposure, or handling beyond the stated material properties.

5. Pricing & Payment

Prices are calculated dynamically based on:

  • Geometry
  • Material
  • Volume
  • Manufacturing complexity
  • Production routing

All prices are confirmed at checkout and payable in full prior to production.

Prices may include manufacturing, handling, and platform fees, but exclude customs duties, taxes, or import fees unless explicitly stated.

6. Production & Lead Times

Production begins only after payment is received.

Lead times provided are estimates, not guarantees, and may vary due to:

  • Manufacturing capacity
  • Material availability
  • Technical adjustments required for production validation
  • Logistics and shipping conditions

Molldi will make reasonable efforts to meet stated timelines but is not liable for delays beyond its control.

7. Order Changes, Cancellations & Returns

Due to the custom-made nature of the products:

  • Orders cannot be changed or canceled once production has begun
  • Returns or refunds are not accepted except in cases of material non-conformity or manufacturing defects

If a product is materially defective, Molldi will, at its discretion:

  • Repair the product
  • Replace the product
  • Issue a partial or full refund

This determination is solely at Molldi’s discretion.

8. Delivery & Risk Transfer

Delivery terms will be specified at checkout or in the order confirmation.

Risk of loss or damage transfers to the Customer upon delivery to the Customer.

The Customer is responsible for inspecting the product upon delivery and reporting any visible damage within a reasonable timeframe.

9. Warranty Disclaimer

Except as explicitly stated, Molldi products are provided “as is” and “as manufactured”.

Molldi disclaims all warranties, express or implied, including but not limited to:

  • Implied warranties of merchantability
  • Fitness for a particular purpose

Normal wear, aging, environmental exposure, and aesthetic variation are not covered by warranty.

10. Limitation of Liability

To the maximum extent permitted by law:

  • Molldi shall not be liable for indirect, incidental, or consequential damages
  • Molldi’s total liability shall not exceed the amount paid for the specific product giving rise to the claim

This limitation applies regardless of the legal theory asserted.

11. Intellectual Property

All designs, parametric systems, and manufacturing logic remain the intellectual property of Molldi.

The Customer receives a license to use the purchased product but acquires no rights to reproduce, modify, or commercially exploit the design.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

Any disputes shall be resolved in the competent courts of that jurisdiction.
